By downloading, installing, or using the LexiqOn mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

LexiqOn is developed and operated by **LLC NorsKod** (DUNS: 933923014), a company registered in Kyrgyzstan.

2. Description of Service

LexiqOn is an AI-powered vocabulary learning application for iOS devices that provides:
- Vocabulary assessment tests
- AI-powered speech analysis (optional paid feature)
- Personalized learning recommendations
- Progress tracking and analytics
- Gamification features (achievements, streaks, levels)

3. Eligibility

You must be at least **13 years old** to use LexiqOn. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18, you confirm that you have obtained parental or guardian consent to use the App.

4. Account and Registration

LexiqOn does not require account creation for basic usage. All data is stored locally on your device. Optional iCloud sync requires an active Apple ID.

5. Subscriptions and Payments

5.1. Free Plan
The App offers limited free access including:
- 1 vocabulary test per day
- Basic progress tracking
- Gamification features

5.2. Premium Subscriptions
Premium subscriptions unlock additional features:
- Up to 5 vocabulary tests per day
- Detailed analytics and insights
- Personalized learning plans
- Premium achievements
- Priority support

5.3. Voice Analysis Add-on
AI-powered speech analysis is available as a separate one-time purchase for $4.99.

5.4. Payment Processing
All payments are processed through Apple's In-App Purchase system. By purchasing a subscription, you agree to Apple's Terms of Service and payment terms.

5.5. Automatic Renewal
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

5.6. Managing Subscriptions
You can manage and cancel subscriptions at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period.

5.7. Refunds
Refund requests are handled by Apple according to their refund policy. We offer a 7-day satisfaction guarantee for first-time subscribers.

6. User Conduct

You agree to use LexiqOn only for lawful purposes. You must not:
- Attempt to reverse engineer, decompile, or hack the App
- Use the App to harass, abuse, or harm others
- Violate any applicable laws or regulations
- Attempt to gain unauthorized access to our systems
- Share your account credentials with others
- Use automated systems or bots to interact with the App

7. Intellectual Property Rights

7.1. Ownership
LexiqOn and all its content, features, and functionality are owned by LLC NorsKod and are protected by international copyright, trademark, and other intellectual property laws.

7.2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use LexiqOn for personal, non-commercial purposes in accordance with these Terms.

7.3. User Content
You retain all rights to any content you create using the App (e.g., test results, learning data). By using the App, you grant us a limited license to process this data to provide the Service.

8. Privacy and Data Protection

10. Disclaimers and Limitations of Liability

10.1. "As Is" Basis
LexiqOn is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10.2. Accuracy
While we strive for accuracy, we do not guarantee that:
- Vocabulary size estimates are 100% accurate (typical accuracy: ±1,000 words)
- The App will be error-free or uninterrupted
- All content is complete, accurate, or current

10.3. Limitation of Liability
To the maximum extent permitted by law, LLC NorsKod shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App
- Any unauthorized access to or use of our servers
- Any bugs, viruses, or other harmful code
- Any content obtained from the App
- Any errors or omissions in any content

**Maximum Liability:** Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

11. Educational Purpose

LexiqOn is designed for educational and personal development purposes. It is **not** a substitute for:
- Professional language instruction
- Academic testing or certification
- Medical or therapeutic interventions

Results and recommendations are AI-generated and should be used as guidance, not absolute truth.

12. Changes to the App

We reserve the right to:
- Modify, suspend, or discontinue any part of the App at any time
- Update features, pricing, or functionality with notice
- Limit access to certain features based on subscription level

We will provide reasonable notice of significant changes via in-app notifications or email.

13. Termination

13.1. By You
You may stop using the App at any time. To delete your data, use the "Clear Data" option in Settings or delete the App.

13.2. By Us
We may suspend or terminate your access to the App if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse the Service

13.3. Effect of Termination
Upon termination:
- Your right to use the App ceases immediately
- Subscriptions will be cancelled (no refund for unused time)
- Locally stored data remains on your device until you delete the App

14. Dispute Resolution

14.1. Governing Law
These Terms are governed by the laws of **Kyrgyzstan**, without regard to conflict of law provisions.

14.2. Arbitration
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Bishkek, Kyrgyzstan, except where prohibited by law.

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.

14.4. Exceptions
You may bring claims in small claims court if they qualify, and we may seek injunctive relief for intellectual property violations.

15. Apple-Specific Terms

15.1. Acknowledgment
You acknowledge that these Terms are between you and LLC NorsKod, not Apple. Apple is not responsible for the App or its content.

15.2. Scope of License
The license granted is limited to a non-transferable right to use the App on Apple-branded devices you own or control.

15.3. Maintenance and Support
LLC NorsKod is solely responsible for maintenance and support. Apple has no obligation to provide support.

15.4. Warranty
Apple provides no warranty for the App. Any claims, losses, or damages related to the App are the responsibility of LLC NorsKod, not Apple.

15.5. Product Claims
LLC NorsKod, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property infringement.

15.6. Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them.

16. General Provisions

16.1. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LLC NorsKod regarding the App.

16.2. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

16.3. Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4. Assignment
You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

16.5. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via:

Continued use of the App after changes constitutes acceptance of the modified Terms.
